(Art. 13 of Legislative Decree 196/2003 as amended, Italian Privacy Code – Arts. 13 and 14, EU Regulation 2016/679 GDPR)
The European Regulation 2016/679 (GDPR), applicable in all Member States, grants every person the protection of their personal data processed by third parties, as an expression of respect for human dignity and for the fundamental rights and freedoms of the individual.
In accordance with the provisions of the above Regulation, we wish to inform you that your data will be processed in full compliance with the principles of lawfulness, fairness, relevance, proportionality and transparency, and with protection of the confidentiality of your data and rights, as required by those legal provisions.
We also inform you that, in order to establish and/or perform the existing contractual relationships and to comply with specific legal obligations, we need to collect your personal data, or will need to collect it later, without the need for your further consent, which is implicit in the conclusion of the contract/agreement between the parties and/or in the assignment of the engagement.
Therefore, in accordance with the European and national regulations in force, we provide you with the following information.
- Personal data processed
In order to handle your commercial request and/or the engagement/contract between the parties, we need to use some of your personal data. These are identification data and contact details (address, landline, mobile phone, fax, e-mail).
- Purposes, legal basis and mandatory or optional nature of the processing
The purposes for which your data is processed are linked to the performance of the contractual and pre-contractual relationships between the parties, to compliance with the rules and legal obligations to which the Data Controller is subject, and to the pursuit of the legitimate interests of the Data Controller or of third parties, where previously authorised.
Please note that providing this data is mandatory, in the sense that otherwise we would be unable to carry out, in whole or in part, the engagement mentioned above, and that your data may also be collected from other parties.
Any processing of your data for further purposes other than those indicated will be the subject of a specific, separate notice and of a specific consent, which is not binding for the performance of the contract in question.
- Data Controller
The Data Controller is: Michele Nave.
Any Data Processors will be appointed when the Controller assigns external engagements that require sharing your data, among those who provide sufficient guarantees to implement appropriate technical and organisational measures, so that the processing meets the requirements of the Regulation and ensures the protection of the rights of the data subject, and after the Processor has signed a specific contract/addendum to the professional engagement setting out the requirements and specifications of the processing.
- Recipients of personal data
Your data will be made known to our internal administrative staff, specifically authorised, and to our external collaborators, appointed for this purpose as Processors of the specific processing, whose list is available at our premises.
This data will also be communicated to our service providers, such as IT service companies, outsourcing companies, consultants and freelance professionals, bodies and/or agencies, companies or bodies appointed by us as Processors of the specific processing, whose list is available to you at our premises.
- Data transfers
Since some of your Personal Data is transferred to Recipients who may be located outside the European Economic Area, the Controller ensures that the electronic and paper processing of your Personal Data by the Recipients takes place in compliance with the Applicable Law.
- Methods of processing and storage of data
The data will be processed and stored using automated IT and/or paper-based means and tools, allowing you to access the personal data we hold, in the manner best suited to guarantee its integrity, accuracy, security and confidentiality, also protecting it from unauthorised and/or unlawful processing and from accidental loss, destruction or damage.
Without prejudice to communications made in compliance with legal obligations, the data may be communicated to external parties carrying out specific tasks on our behalf, subject to their express commitment to protect your personal data in accordance with this Notice and with the rules on Data Processors set out in Articles 28 et seq. of EU Regulation 2016/679 GDPR, as well as with the applicable laws.
- Duration of the processing
The data will be processed for the entire duration of the relationships established between the parties and, after the end of the relationship/contract, to comply with the civil and tax obligations applicable to it, as well as with any other legal obligation to which the Controller is subject.
- Rights of the data subject
At any time you may exercise, by written request to the Data Controller identified above, all the rights granted by the applicable European and national regulations, in particular by Articles 13, 14, 15 to 22 and 34 of the European Regulation and by the national legislation in force, and in particular:
- the right to obtain confirmation as to whether or not data concerning you exists, even if not yet recorded, and to have it communicated in an intelligible form; the right to obtain free of charge access to and/or a copy of your personal data being processed, with an indication of all the relevant aspects of the processing set out in the EU Regulation;
- the right to obtain free of charge the updating and rectification of inaccurate data, the restriction of processing or, where you have an interest, the completion of the data;
- the right to object, in whole or in part, for legitimate reasons, to the processing of personal data concerning you, even if relevant to the purposes of the collection, or to withdraw, in whole or in part, your consent where it is required;
- the right to lodge a complaint with a supervisory authority (the Italian Data Protection Authority, Garante per la protezione dei dati personali) or with a judicial authority.
